The Repairing Standard for private rented housing in Scotland (set out in the Housing (Scotland) Act 2006 and subsequent regulations) was updated, with important changes commencing on 1 March 2024. These amendments strengthen safety in rental properties, including protection from electrical hazards. Residual Current Devices (RCDs): A New Requirement

What are RCDs?

Residual Current Devices (RCDs) are electrical safety devices designed to immediately switch off the supply of electricity when electricity leaking to earth is detected at a harmful level.

The New Regulation

From 1 March 2024, private rented homes must have appropriate Residual Current Device (RCD) protection in the consumer unit (fuse box) in line with BS 7671, so that relevant circuits (including socket outlets likely to be used by tenants) are RCD‑protected. This requirement is part of the Repairing Standard, which the Scottish Government sets as the minimum standard for private rented housing across Scotland.

Implications for Landlords

  • Compliance: If there is no appropriate RCD protection, the property does not meet the Repairing Standard.
  • Installation: If you do not already have RCD protection, arrange installation by a competent (registered) electrician.
  • Inspections: Electrical inspections should confirm RCD presence and correct operation (including trip‑time testing) in line with BS 7671 and be included in routine procedures.

  • Records: Keep copies of EICRs, PAT results, and any remedial work.

  • Landlords are obliged to guarantee that all electrical items that they supply are safe to use.
  • Do not use counterfeit electrical products which may contain faulty parts that could increase the risk of fire or electric shock.
  • Register appliances with manufacturers via Register My Appliance and check for recalls. Remove or repair recalled items.

3. Proper and safe availability of electrical power

  • Electricity supply must be available, safe and functioning at the property to the necessary standard.
  • This covers all electrical installations, fixtures, fittings and apparatus.

4. Alarms (Repairing Standard – reminder)

  • Interlinked smoke and heat alarms remain mandatory in private lets.
  • Carbon monoxide alarms are required in any room with a fuel‑burning appliance (e.g., gas boiler, stove).

Steps for Landlords Compliance

  1. Conduct an Audit: Cross‑check your properties to identify where RCDs need to be installed or upgraded.
  2. Hire a Registered/Competent Electrician: Ensure electrical work is carried out by a competent person.
  3. Schedule Regular Inspections: Schedule EICR and PAT testing across your properties.
  4. Document Everything: Keep records of installations, inspections and maintenance.
  5. Educate Tenants: Explain basic electrical safety and how RCDs work (e.g., how to test and what to do if they trip).
